◆ 사건 개요 및 판결

청주지법 형사4단독 강현호 판사는 보험사기방지 특별법 위반과 폭력행위처벌법 위반(공동공갈) 혐의로 구속기소된 A(20대)씨에게 징역 1년6개월을 선고했다고 10일 밝혔다.

같은 혐의로 기소된 공범 B씨 등 6명에게는 징역 4개월에서 1년에 집행유예 2년에서 3년을 선고했다.

◆ 범행 수법 및 피해 규모

A씨 등은 2020년 2월부터 지난해 4월까지 충북 청주시 일대에서 4년여간 음주운전 의심 차량과 고의 사고를 내는 수법으로 범행했다. 이들은 20여차례에 걸쳐 보험금 1억5000여만원을 받아냈다.

피해자들을 신고 무마를 빌미로 협박해 20여차례에 걸쳐 4500여만원의 금품을 갈취한 혐의도 받았다.

지역 선후배 관계인 A씨 등은 유흥업소 밀집지역을 배회하며 음주 의심자가 차량을 몰면 쫓아가 정차시키거나 추돌사고를 냈다. 회전위반 차량, 교차로 내 꼬리물기 차량, 역주행 차량 등을 발견하면 오히려 속도를 높여 사고를 낸 것으로 조사됐다.

◆ 판결 이유

강 판사는 "피고인들은 매우 치밀하고 조직적으로 범행을 저질러 엄중한 경고가 필요하다"고 밝혔다.

강 판사는 "이번 범행은 보험제도를 위태롭게 하고 공동체 보험지출을 증가시키는 등 사회 전반에 끼치는 해악이 크다"고 판시했다.

◆ Case Overview and Verdict

Judge Kang Hyun-ho of the Criminal Division 4 of Cheongju District Court announced on the 9th that he sentenced Mr. A (in his 20s), who was indicted under detention for violating the Special Act on Insurance Fraud Prevention and the Punishment of Violences Act (joint extortion), to 1 year and 6 months in prison.

Six accomplices including Mr. B, who were indicted on the same charges, were sentenced to 4 months to 1 year in prison with 2 to 3 years of probation.

◆ Modus Operandi and Extent of Damage

Mr. A and others committed crimes for about 4 years from February 2020 to April of last year in the Cheongju-si, Chungbuk area by deliberately causing accidents with vehicles suspected of drunk driving. They received approximately 150 million won in insurance money over 20 incidents.

They were also charged with extorting approximately 45 million won in cash and goods over 20 incidents by threatening victims with the pretext of covering up reports.

Mr. A and others, who had local senior-junior relationships, wandered around entertainment district areas and chased suspected drunk drivers to stop them or cause rear-end collisions. It was investigated that when they spotted vehicles making illegal turns, vehicles blocking intersections, or vehicles driving in reverse, they actually increased their speed to cause accidents.

◆ Sentencing Reasons

Judge Kang stated, "The defendants committed crimes in a very meticulous and organized manner, requiring a stern warning."

Judge Kang ruled, "This crime endangers the insurance system and increases community insurance expenditures, causing great harm to society as a whole."
