검찰은 휴대전화 포렌식과 GPS 내역 확인 등 객관적 증거를 확보했다. 검찰은 직접 보완 수사를 실시해 경찰 송치 범죄사실 외에 송민호 씨의 무단결근 사실을 추가로 밝혀내 함께 기소했다. 검찰 관계자는 "송 씨 등에게 죄에 상응하는 처벌이 이뤄질 수 있도록 공소 유지에 만전을 기할 것"이라고 밝혔다.
