◆ 검찰 "계획적·조직적 범행, 반성 없어" 징역 2년 구형

검찰이 더불어민주당 송옥주 의원에게 징역 2년을 재차 구형했다. 수원고법 형사3부(재판장 김종기)는 22일 송 의원에 대한 공직선거법 위반 혐의 결심공판을 열었다. 검찰은 "선거일에 임박해 불특정 다수를 상대로 상당한 기간 범행이 이뤄졌다"고 밝혔다. 검찰은 "계획적·조직적으로 상호 공모해 범행했음에도 피고인이 범행을 전면 부인하며 반성하지 않아 죄질이 불량하다"고 구형 이유를 설명했다.

◆ 송 의원 측 "의정활동 범위 내 행위" 무죄 주장

송 의원 측 변호인은 최후 변론에서 "피고인은 어르신의 날 외형을 가장해 기부 행위를 한 사실이 없다"고 반박했다. 변호인은 "국회의원이 후원자에게 후원이 필요한 단체를 소개·연결하는 것은 의정활동으로 허용된다"며 무죄를 요청했다. 송 의원은 최후 진술에서 "정치인이 주민 모임 장소를 방문해 인사하고 사진 찍는 것은 의례적 의정활동"이라고 주장했다. 송 의원은 "이를 모두 선거법 위반으로 몰아가면 지역 주민을 위한 정치활동이 위축된다"고 호소했다.

◆ 1심 집행유예 선고…선고 기일 내년 1월 27일

송 의원은 2023년 10월부터 2024년 3월까지 지역구 경로당 수십 곳에서 행사를 열었다. 송 의원은 선거구민에게 TV, 음료, 식사 등 총 2563만원 상당 물품을 제공한 혐의로 기소됐다. 1심 재판부는 "조직적·계획적 범행은 송옥주의 지시 또는 승인이 있었기에 가능했다"며 징역 1년에 집행유예 2년을 선고했다. 재판부는 내년 1월 27일 선고 기일을 진행한다. 공직선거법상 선출직 공직자가 징역형이나 100만원 이상 벌금형을 확정받으면 당선이 무효가 된다.

◆ Prosecutors cite "planned and organized crime with no remorse" in seeking 2-year term

Prosecutors sought a two-year prison sentence again for Democratic Party of Korea Rep. Song Ok-joo. The Criminal Division 3 of the Suwon High Court, presided by Judge Kim Jong-ki, held the final hearing on Song's public election law violation charges on December 22. Prosecutors stated that "the crime was committed against an unspecified large number of people over a considerable period close to election day." Prosecutors explained the sentencing request by saying "the defendant shows poor criminal conduct as she continues to deny all charges and shows no remorse despite evidence of planned and organized conspiracy."

◆ Song's defense claims "actions within scope of legislative activities" and seeks acquittal

Song's defense attorney countered in closing arguments that "the defendant never disguised donation activities as Senior Citizens' Day events." The attorney requested an acquittal, stating that "introducing and connecting sponsors to organizations in need of support is a permitted legislative activity for lawmakers." Song argued in her final statement that "politicians visiting community gatherings to greet residents and take photos constitutes customary legislative activity." Song appealed that "political activities for local residents will be suppressed if all such activities are treated as election law violations."

◆ First trial resulted in suspended sentence…Sentencing scheduled for January 27 next year

Song held events at dozens of senior centers in her district from October 2023 to March 2024. Song was indicted for providing goods worth approximately 25.63 million won, including televisions, beverages, and meals, to constituents. The first trial court sentenced Song to one year in prison with a two-year suspension, ruling that "the organized and planned crime could only have occurred with Song Ok-joo's instruction or approval." The court scheduled the sentencing for January 27, 2025. Under Korea's Public Official Election Act, elected officials automatically lose their seats if their prison sentences or fines of one million won or more are finalized.
