◆ 의원직 유지 확정…피고인 측 "보복 기소" 반발

검찰 구형대로 선고가 이뤄지면 박범계·박주민 의원은 의원직을 유지하게 된다. 일반 형사 사건은 금고 이상 형이 확정돼야 의원직을 상실한다. 검찰은 구형 이유로 "피해자들의 피해 정도, 관련 사안의 진행 경과와 선고 경위 등을 고려했다"고 밝혔다. 박범계 의원은 최후 진술에서 "이 사건은 검찰의 선별적 보복 기소"라고 주장했다. 박주민 의원은 "물리력을 행사한 기억도 정황도 없다"며 "감정에 기반한 무리한 기소"라고 반박했다. 김정곤 재판장은 "재판 지연으로 사회적 손실이 컸다"며 "실체적 진실에 부합하는 결론을 내리겠다"고 밝혔다. 1심 선고 기일은 다음 달 19일 오후 2시다.

◆ 패스트트랙 충돌 사건 경과

패스트트랙 충돌은 2019년 4월 발생했다. 민주당이 공수처법과 준연동형 비례대표제를 패스트트랙에 상정하는 과정에서 여야 간 몸싸움이 벌어졌다. 민주당 전·현직 의원 등 10명은 국회 의안과 앞과 628호 과학기술정보방송통신위원회 회의실 앞에서 당시 자유한국당 당직자들을 폭행한 혐의로 기소됐다. 같은 사건으로 기소된 나경원·송언석 국민의힘 의원 등 자유한국당 관계자들은 지난 20일 1심에서 의원직 상실형 미만의 벌금형을 선고받았다. 검찰이 항소를 포기하면서 국민의힘 현직 의원 전원이 의원직을 유지하게 됐다.

Park Joo-min countered, "I have no memory or circumstance of using physical force" and called it "an unreasonable indictment based on emotion." Presiding Judge Kim Jeong-gon said, "Social losses were significant due to trial delays" and pledged to "reach a conclusion consistent with substantive truth." The first trial sentencing date is December 19 at 2 p.m.

◆ Background of Fast-Track Clash Case

The fast-track clash occurred in April 2019. Physical confrontations broke out between ruling and opposition parties as the Democratic Party placed the Corruption Investigation Office for High-ranking Officials Act and semi-proportional representation system on the fast track. Ten current and former Democratic Party lawmakers were indicted for assaulting Liberty Korea Party officials in front of the National Assembly Bills Division and Conference Room 628 of the Science, Technology, Information, Broadcasting and Communications Committee. Liberty Korea Party members including Reps. Na Kyung-won and Song Eon-seok of the People Power Party received fines below the threshold for losing their seats in the first trial on November 20. All current People Power Party lawmakers retained their seats after prosecutors waived their right to appeal.
