◆ 대전지법, 박준철씨에 징역 10개월 집행유예 2년 선고

박세리희망재단이 새만금 국제골프학교 설립 사업에 참여하도록 한 박세리 부친이 징역형 집행유예를 선고받았다. 대전지법 형사6단독 김지영 판사는 17일 사문서위조, 위조사문서행사, 자격모용사문서작성, 자격모용작성사문서행사 혐의로 기소된 박준철씨에게 징역 10개월, 집행유예 2년을 선고했다. 박준철씨는 박세리희망재단에서 맡은 직책이 없었다.

◆ 2021년부터 2년간 권한 없이 문서 위조 제출

박준철씨는 2021년 6월부터 2023년 7월까지 새만금 국제골프학교 설립 사업에 자신이 박세리희망재단의 권한이 있는 것처럼 행세했다. 임의로 새긴 도장을 날인하고 참가 의향서를 꾸며 제출한 혐의다. 박준철씨는 당시 박세리희망재단의 직책을 맡지 않았고 권한도 위임받지 않은 채 서류를 만들어 제출했다. 업체 간 협약까지 이뤄졌으며 위조된 문서에 대해 소명 요청을 받자 회장으로서 권한이 있는 것처럼 사실관계 확인서를 제출했다. 박준철씨는 재판 과정에서 "위임받지 않았으나 묵시적 위임이 있다고 믿었다"고 주장했다.

◆ 재판부 "법률적 권한 없음 알면서 범행"

재판부는 "피고인이 재단으로부터 업무를 위임받거나 대신해 업무를 처리했다고 볼만한 사정이 없다"며 "자신에게 법률적인 권한이 없음을 알면서도 사건에 이르렀다"고 판시했다. 재판부는 "다만 피고인이 작성한 문서는 의향서 내지 사실관계 확인서로 재단에 법률적 의무를 부과하는 문서로 보기 어렵다"며 "사건으로 실질적인 피해가 발생하지 않았고 동종범죄로 처벌받은 전력이 없는 점 등을 고려했다"고 밝혔다.

◆ Daejeon District Court Sentences Park Jun-cheol to 10 Months Prison, Suspended for 2 Years

Park Se-ri's father, who had the Park Se-ri Hope Foundation participate in the Saemangeum International Golf School establishment project, was sentenced to a suspended prison term. Judge Kim Ji-young of the 6th Criminal Division of Daejeon District Court sentenced Park Jun-cheol on December 17 to 10 months in prison, suspended for 2 years, on charges of private document forgery, use of forged private documents, preparation of private documents by assuming qualification, and use of private documents prepared by assuming qualification. Park Jun-cheol held no position at the Park Se-ri Hope Foundation.

◆ Forged and Submitted Documents Without Authority for 2 Years Starting 2021

Park Jun-cheol acted as if he had authority from the Park Se-ri Hope Foundation in the Saemangeum International Golf School establishment project from June 2021 to July 2023. He was charged with stamping an arbitrarily engraved seal and fabricating and submitting a letter of intent to participate. Park Jun-cheol created and submitted documents without holding any position at the Park Se-ri Hope Foundation or receiving delegated authority at the time. An agreement between companies was even reached, and when asked to explain the forged documents, he submitted a fact confirmation letter as if he had authority as chairman. Park Jun-cheol claimed during the trial that "although I was not delegated authority, I believed there was implicit delegation."

◆ Court Rules "Committed Crime Knowing No Legal Authority"

The court ruled, "There are no circumstances to believe that the defendant was delegated work from the foundation or handled work on its behalf," adding that "the defendant proceeded with the case knowing he had no legal authority." The court stated, "However, the documents prepared by the defendant are letters of intent or fact confirmation letters, which are difficult to view as documents imposing legal obligations on the foundation," adding that "we considered that no actual damage occurred from the case and that there is no prior record of punishment for similar crimes."
