◆ 서울고법, 돈봉투 수수 의원 3명 전원 무죄 선고

더불어민주당 전당대회 돈봉투 수수 혐의로 기소된 전·현직 국회의원들이 2심에서 무죄를 선고받았다. 서울고법 형사2부(김종호 부장판사)는 18일 정당법 위반 등 혐의로 기소된 민주당 허종식 의원과 윤관석·임종성 전 의원에게 무죄를 선고했다. 이들은 2021년 4월 28일 열린 송영길 전 대표(현 소나무당 대표) 지지 국회의원 모임에 참석해 300만 원이 든 돈봉투를 1개씩 받은 혐의를 받았다.

◆ 1심 유죄 판결 뒤집혀

1심은 허 의원에게 징역 3개월에 집행유예 1년, 윤 전 의원에게 징역 9개월에 집행유예 2년, 임 전 의원에게 징역 3개월에 집행유예 1년을 선고하고 300만 원 추징을 명령했다. 검찰은 허 의원과 윤 전 의원, 임 전 의원에게 각각 징역 1년을 구형했다. 그러나 항소심 재판부는 1심 판결을 뒤집고 전원 무죄를 선고했다.

◆ 재판부 "위법수집증거…유죄 인정 증거 부족"

항소심 재판부는 검찰 측 증거인 이정근 전 민주당 사무부총장 휴대전화가 위법수집증거에 해당한다고 판단했다. 재판부는 "유죄 증거로 삼은 상당 부분의 증거들이 배제되는 등 남은 증거들은 공소사실을 유죄로 인정하기 충분치 않다"고 판시했다.

◆ Seoul High Court Acquits All 3 Lawmakers in Money Envelope Case

Former and current lawmakers indicted for receiving money envelopes at the Democratic Party convention were acquitted in the appeals trial. Seoul High Court Criminal Division 2 (Presiding Judge Kim Jong-ho) on the 18th acquitted Democratic Party lawmaker Heo Jong-sik and former lawmakers Yoon Gwan-seok and Im Jong-seong, who were indicted on charges including Political Party Act violations. They were accused of receiving envelopes containing 3 million won each at a gathering of lawmakers supporting then-leader Song Young-gil (current Sonamu Party leader) held on April 28, 2021.

◆ First Trial Guilty Verdicts Overturned

The first trial sentenced lawmaker Heo to 3 months imprisonment with 1 year probation, former lawmaker Yoon to 9 months imprisonment with 2 years probation, and former lawmaker Im to 3 months imprisonment with 1 year probation, also ordering 3 million won in forfeitures. Prosecutors had sought 1 year imprisonment for each of lawmaker Heo, former lawmaker Yoon, and former lawmaker Im. However, the appeals court overturned the first trial verdict and acquitted all defendants.

◆ Court Rules "Illegally Obtained Evidence...Insufficient for Conviction"

The appeals court determined that the prosecution's evidence, former Democratic Party Deputy Secretary General Lee Jeong-geun's mobile phone, constituted illegally obtained evidence. The court ruled "A significant portion of evidence used for conviction has been excluded, and the remaining evidence is insufficient to recognize the charges as guilty."
